From car accidents to industrial accidents, there are several ways to be injured or killed in Georgia. It is rare that someone else causes the death of another person, either through malicious actions or reckless behavior, but the civil court system stands ready to hear these claims from the survivors of victims of wrongful death.
The widow of a man killed by gunshots from sheriff’s deputies during the execution of a search warrant filed a wrongful death complaint against the sheriff’s office employing the officers at the time. The men reportedly broke into the couple’s home and shot the victim four times.
The lawsuit claims that the deputy responsible for acquiring the search warrant lied on the application before it was signed by a judge. The event occurred after the home in question was the site of a robbery, in which the alleged culprit made off with a vehicle and firearms. When deputies arrested the suspect, he also claimed he found methamphetamine and drug paraphernalia in the home.
This statement was never corroborated before it was included in the warrant application, and drugs were never found in the home after the search. The lawsuit claims the deputies also broke in without warning and began firing weapons.
The sudden loss of a loved one is traumatic enough when the death is not someone else’s fault. But the survivors of victims of wrongful death, even at the hands of law enforcement officers, have the right to claim compensation in civil court. No one should have to go through this difficult time without legal assistance.
