Wrongful death lawsuit verdict challenged by defendant

Although people may pass away at any time for reasons that may not be preventable, people and organizations can sometimes be liable for a loss of life. This is why Georgia and other states allow civil lawsuits for wrongful death. Nothing can bring a life back, but liability may be found and financial damages may be available for the survivors of victims.

A lawsuit brought on behalf of a man who died of complications from overheating is possibly still active after a jury verdict on his behalf. Lawyers representing the defendant are asking a court to set aside the jury verdict because it allegedly violates Georgia law.

A state court jury in Muscogee County awarded $125 million to the victim's daughter after finding the owners of his apartment building partially liable for his death. Since the defendant is planning an appeal, a judge approved the plaintiff's motion to require a $25 million bond.

"That's the highest that you can get under Georgia law, no matter what the company is worth," said the plaintiff's attorney. "We asked for that. The court granted it. But the court also said we could ask for a higher bond if the circumstances warrant it."
